The course introduces to the study of different procedural models offered by the Italian legal system, in order to achieve the constitutional aim of an effective protection of rights.
For this purpose, the course delves into topics such as the organization of justice, the different models of proceedings.

Learning Objectives
Systematic knowledge of the forms of judicial protection of rights and civil proceedings, namely of the tools aimed to ensure the enforcement of substantial provisions (essentially: civil law; commercial law; labour law; administrative law) even in case of lack of spontaneous cooperation between the parties.
Ability to deal with the main issues emerging within the protection of legally relevant situations, starting from the identification and interpretation of norms, in order to analyse whether the legal system is offering a proper form of judicial protection.
Ability to find useful references and case law for the study and the solution of concrete cases.
Attitude as to the role of a lawyer expert in judicial protection of legally relevant situations.
Learning Objectives
This course enables students to learn the discipline of ordinary criminal trial court and the Court of Assizes, in order to understand the performance of a criminal trial. Will be taken all the useful teaching methods to facilitate the study of matter (diagrams, flow charts, examples of acts) ..

The course introduces to the study of different procedural models offered by the Italian legal system, in order to achieve the constitutional aim of an effective protection of rights.
For this purpose, the course delves into topics such as the organization of justice (constitutional provisions on jurisdiction, evolution of the relation between ordinary jurisdiction and special jurisdiction in light of the most recent interventions of the Court of cassation and the Council of state), the decisions, the different models of proceedings (ordinary proceedings, summary proceedings, provisional remedies, enforcement).

The course will be devoted to the illustration of the dynamics of the case. Will consider: the preliminary investigation and the preliminary hearing; means of gathering evidence and the defense investigations; precautionary measures; the trial; the special procedures and the concept of res judicata and its effects. They are, finally, an examination subject to the general principles on appeals.
